1. Acceptance of Terms
Welcome to Viac Lifestyle. These Terms of Service ("Terms") govern your access to and use of the website viaclifestyle.vercel.app and all related content, features, and services (collectively, the "Services") provided by Viac Lifestyle ("Viac", "we", "us", or "our").
By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Services.
2. Description of Services
Viac Lifestyle provides marketing and informational content related to luxury real estate, vacation rentals, property management, and investment in South Florida. Where applicable, we facilitate connections between visitors and:
- Vacation rental booking platforms (such as Guesty and Airbnb)
- Real estate professionals and partners
- Property management and concierge services
We do not directly process bookings or payments on this Site. Bookings are completed and managed through third-party platforms, each governed by its own terms.
3. Eligibility
You must be at least 18 years old (or the age of legal majority in your jurisdiction) and able to enter into a binding contract to use the Services. By using the Services, you represent and warrant that you meet these requirements.
4. User Conduct
You agree not to:
- Use the Services for any unlawful purpose or in violation of applicable laws
- Provide false, misleading, or fraudulent information
- Attempt to gain unauthorized access to any portion of the Site, our systems, or other users' accounts
- Interfere with or disrupt the Site, servers, or networks
- Use any robot, scraper, or other automated means to access the Services without our prior written consent
- Copy, reproduce, distribute, or create derivative works of any content without authorization
- Submit content that is defamatory, obscene, harassing, or infringes any third party's rights
5. Property Listings & Bookings
Property listings displayed on the Site are provided for informational purposes. Availability, pricing, amenities, and descriptions are subject to change without notice and are ultimately governed by the booking platform on which the reservation is made.
We make reasonable efforts to keep listings accurate, but we do not guarantee that all information is complete, current, or error-free. Photographs are illustrative and may not reflect the exact appearance of a property at any given time.
6. Pricing, Fees & Payments
All bookings are completed on third-party platforms (such as Guesty or Airbnb). Pricing, taxes, security deposits, cleaning fees, and other charges are set by those platforms and the applicable property owner. You agree to comply with the payment terms of the platform through which you book.
7. Cancellations & Refunds
Cancellations, modifications, and refunds are governed by the cancellation policy of the booking platform and/or specific listing under which your reservation is made. Please review the cancellation policy carefully before completing a booking.
8. Disclaimers
The Services are provided on an "AS IS" and "AS AVAILABLE" basis. To the fullest extent permitted by law, Viac Lifestyle disclaims all warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, non-infringement, and any warranty arising from a course of dealing or usage of trade. We do not warrant that the Services will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
No content on the Site constitutes legal, financial, tax, or investment advice. You should consult qualified professionals before making any decision based on information presented here.
9. Limitation of Liability
To the maximum extent permitted by law, Viac Lifestyle and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or relating to your use of (or inability to use) the Services, even if we have been advised of the possibility of such damages.
Our total aggregate liability for any claim arising out of or relating to these Terms or the Services will not exceed one hundred U.S. dollars ($100). Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
10. Indemnification
You agree to indemnify, defend, and hold harmless Viac Lifestyle and its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (i) your use of the Services; (ii) your breach of these Terms; (iii) your violation of any law or the rights of a third party; or (iv) any content you submit through the Services.
11. Intellectual Property
All content on the Site — including text, graphics, logos, images, videos, downloadable guides, the look and feel, and the underlying code — is the property of Viac Lifestyle or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Site for personal, non-commercial purposes. No other rights are granted, expressly or by implication.
12. Third-Party Links
The Site may contain links to third-party websites, services, and content that are not owned or controlled by Viac Lifestyle. We are not responsible for the content, privacy policies, or practices of any third-party sites. Your interactions with third parties are solely between you and them.
13. Termination
We may suspend or terminate your access to the Services at any time, for any reason, without notice. Upon termination, your right to use the Services ceases immediately. The sections of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
14. Governing Law & Disputes
These Terms are governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict-of-law principles.
Any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be resolved exclusively in the state or federal courts located in Broward County, Florida, and you consent to the personal jurisdiction of such courts.
You agree that any cause of action arising out of or related to the Services must commence within one (1) year after the cause of action accrues. Otherwise, such cause of action is permanently barred.
15. Changes to Terms
We may modify these Terms at any time. When we do, we will revise the "Last updated" date at the top of this page. Your continued use of the Services after the changes become effective constitutes your acceptance of the revised Terms.
